Erik Still Wants Sony's Blood After Being Banned On PSN.

Remember Erik Estavillo? Dude, acted like a knob on Resistance: Fall Of Man and decided to sue Sony when they banned him. He lost his lawsuit, but now he wants to appeal.

GamePolitics reports:

Estavillo also filed (on October 14th) a civil lawsuit against SCEA in Superior Court of California, County of Santa Clara seeking $180,000.

Estavillo tells GP he is representing himself in these cases and, in light of his PSN ban, is playing the Wii (Metroid Trilogy) and Xbox 360 (Mortal Kombat vs. DC Universe). Estavillo said that he loves playing as The Joker in the latter title and may be “a bit obsessed” with the character, adding, “I plan to wear a purple suit during my court trials. No joke!”

Remember Erik – the PSN user who’d acted like a jerk on PSN and then tried to sue Sony when he got banned? Dudes legal proceedings didn’t hold much water. Erik Estavillo tried to sue Sony on the basis that following his ban he was being denied services he had paid for. He also came up with some sob story regarding agrophobia.

Regardless, the case all got tossed out by Judge Ronald M. Whyte. He ruled there was no plausible First Amendment claim in the case. Sony all along maintained that First Amendment protections have no relevance to the PSN, which is a private accommodation.

So there you have it Erik. Perhaps if you hadn’t acted like a jerk on the PSN and played nicely, you wouldn’t have got banned at all? Perhaps.

Would you sue Sony if you were banned from the Playstation Network? It’s a question that we’ve mulled over for a considerable length of time while planning this piece. On many counts we think no – because at the end of the day we’d probably have to have been a prick in order to get banned in the first place right?

Still, that’s what Erik Estavallo is doing – after being an utter jerk in Resistance he’s decided to file a lawsuit against Sony; because they tried to clean their community up. A court document from GamePolitics argues:

“The plaintiff was exercising his First Amendment Rights to Freedom of Speech in the game’s public forum when he was banned from, not only [Resistance], but also banned from playing all other games online via the PlayStation Network.” As such “pain and suffering”  has been caused by Sony because the PS3 is “the only way the plaintiff can truly socialize since he also suffers from agoraphobia.”

Excuse us for not knowing the entire story but, goodness gracious, this has to be a joke right? The document further goes on to reveal that the “victim” demands $55,000 in damages and demands Sony no longer implement bans of “any sort”. He claims that “PlayStation 3 is the only system that incorporates this type of wide-ranged ban. As where Nintendo does not ban customers at all. And Microsoft Xbox rarely bans”.

So hang on, the guy is a dick online but still expects to receive $55,000 for his troubles. Furthermore, he wants his fellow dick gamers to never be threatened with a ban? Are you fucking kidding me.

The fact he cites XBOX Live as “rarely” banning says it all really.

As more elitist British publications would write: only in the USA.
